Tribunal Decision Finalized, No Appeal Filed

Published: Thursday, 26 March 2026

The Ontario Land Tribunal's decision to reject former councillor Joan Delaney's $82,000 cost claim against the Township of Rideau Lakes remains final, as the appellants have chosen not to file an appeal with Divisional Court.

Earlier this month, the Tribunal dismissed the Request for Review filed by Ms. Delaney and Mr. Butcher, upholding the original decision regarding the cost motion. The Tribunal reaffirmed that the Township's actions were reasonable, appropriate, and in full compliance with legal standards, leading to the rejection of the $82,000 claim.

Despite being able to apply for leave to appeal the decision to Divisional Court within 15 days, the appellants have not pursued this option, effectively bringing the matter to a close.

The Tribunal’s ruling, which highlighted that the Township’s conduct was entirely proper, settles the issue, confirming that the cost claim was without merit. The Tribunal also dismissed the personal allegations raised against Township staff and councillors as irrelevant to the planning appeal.

With no further legal action being taken, the public record remains settled, and the Township remains committed to upholding the integrity of the planning and development process for the benefit of all residents.
